Fire Risk Assessments: A Legal Requirement

Fire Risk Assessments are legally required. Failing to have one could result in fines, imprisonment, or both.

You are responsible for fire safety if you are an employer, owner, landlord, occupier, or otherwise in control of the premises (e.g. facilities manager or managing agent). As a 'responsible person', you must work with others in shared responsibility.

Under the Regulatory Reform (Fire Safety) Order 2005 and Scottish fire safety legislation, responsible persons must:

  • Conduct and regularly review a Fire Risk Assessment

  • Keep a written record if the business has 5+ people

  • Inform staff about identified risks

  • Implement and maintain safety measures

  • Plan for emergencies

  • Provide fire safety information and training
